Citing cases from the first ninety volumes[1]

 

The first ninety volumes of the United States Reports (U.S.) contain the names of the respective court reporter. From 1790 to 1874 the court reporter’s name is printed on each volume and is cited, e.g., Marbury v. Madison, 5 U.S. (Cranch) 137 (1803)

 

The following is a list of the full names of the seven reporters along with their name abbreviations as they appear in legal citations, the volume number designations of the U.S. Reports for which each contributed, and their corresponding years of service.

 

A.J. Dallas (Dall.)                                            1-4 U.S. (1789-1800)

William Cranch (Cranch)                                 5-13 U.S. (1801-1815)

Henry Wheaton (Wheat.)                                14-25 U.S. (1816-1827)

Richard Peters (Peters)                                    26-41 U.S. (1828-1842)

Benjamin C. Howard (How.)                           42-65 U.S. (1843-1860)

J.S. Black (Black)                                            66-67 U.S. (1861-1862)

John Williams Wallace (Wall.)                         68-90 U.S. (1863-1874)

 

As I mentioned in class, the authors of textbooks do not always follow the same standard for citing cases. Moreover, we need to modify the citations for cases from 1789-1874.

 

Refer to page 50 of your exciting Civil Liberties text:

 

Marbury v. Madison, 1 CR. (5 U.S.) 137 (1803) should be changed to:

 

Marbury v. Madison, 5 U.S. (Cranch) 137 (1803)

 

Now let’s practice changes the citations in the text to the format outline above.

Citing Cases Correctly

 

Cases from volumes 91 – present should be cited using the following format:

 

Petitioner v. Respondent, volume U.S. page (year)

 

Note: The name of the parties in the case is italicized (including the v. but not the comma).

 

Example: Palko v. Connecticut, 302 U.S. 319 (1937)

 

Find and correct any errors in the case citations listed below:
